Terms of Service

These terms are an agreement between you and Multiply Technologies LLC DBA ThingSong ("ThingSong", "we", "us") and govern your use of the ThingSong app and website. By creating an account or using ThingSong, you agree to them. Our Privacy Policy explains how we handle your information.
1. Eligibility and accounts
You must be at least 18 years old to use ThingSong. You may have only one account, and you are responsible for activity on it. Keep access to your email address or cell phone secure, since that is how you sign in.
If you sign in with a cell number, we text you a one-time code each time you ask for one. We text you about your entries and giveaways, such as when voting opens, results, and pickup times and reminders, only if you turn that on separately with the optional box on the sign-in screen; you don't need it to sign in or use ThingSong. If you join the waitlist with a cell number, we may also text you once when you're invited. Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to stop texts; you can still sign in by email. Carriers aren't liable for delayed or undelivered messages.
2. Contests
Each contest offers one item as a prize and has its own official rules, which describe eligibility, deadlines, how entries are judged and voted on, how the winner is chosen, and how the prize is picked up or delivered. If a contest's official rules conflict with these terms, the official rules control for that contest.
Entry is free. No purchase or payment is necessary to enter or win, and a purchase will not improve your chances. Winners are chosen by the published combination of judges' scores and audience votes, not by chance. Prizes are used items provided as described, and we make no warranty about their condition beyond the description. Winners are responsible for any taxes on prizes, and we may require tax information before awarding a prize where the law requires it. Contests are void where prohibited.
3. Your entries and the license you grant
You keep ownership of your performance. When you submit an entry, you grant ThingSong a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to host, store, stream, reproduce, publish and display your entry, including by uploading it to the ThingSong YouTube channel, and to use your stage name, voice and likeness in connection with the contest and to promote ThingSong. The exact terms you accept are shown when you enter, and we keep a record of the version you accepted. Approved entries get a public link that you, other users and ThingSong can share outside ThingSong, and that anyone can open on our website.
By entering, you confirm that:
- you are the person singing in the video;
- the video does not include other people's images or voices without their permission, or any recorded music such as karaoke or backing tracks;
- if you sing a published song, you understand that its rights holders may claim, monetize or mute the performance on YouTube.
4. Voting and fair play
Each person may vote once per contest, using one account. Buying votes, using multiple accounts, bots, or any other way to manipulate votes or scores is prohibited and may lead to disqualification and account removal.
5. Community rules
ThingSong is family-friendly: everything you submit or post must be fine for a G or PG film. That means no sexual content, drugs or alcohol, violence, hate, or strong language, including as jokes, innuendo or references. Do not submit or post anything that is illegal, harassing, infringing, or that invades someone's privacy. We review entries before they are published, with the help of automated tools including AI, and may reject or remove any entry, or suspend or close any account, that breaks these terms or a contest's rules. You can report entries and block users in the app.
6. YouTube
Performances published on YouTube are also subject to the YouTube Terms of Service. ThingSong uses YouTube API Services to publish and remove those videos.
7. Deleting your account
You can delete your account at any time in the app. We then remove your personal information and the videos ThingSong stores, and keep anonymous placeholders of your entries and votes so contest results stay accurate, as described in our Privacy Policy. The license in section 3 is irrevocable and continues after you delete your account, so performances already published, including on YouTube, may stay published. We may remove them at our discretion.
8. Disclaimers and limits of liability
ThingSong is provided "as is" without warranties of any kind, to the extent permitted by law. We are not liable for indirect, incidental or consequential damages, and our total liability to you for any claim relating to ThingSong is limited to $100, to the extent permitted by law.
9. Governing law
These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules, except where the law of the place you live requires otherwise.
10. Changes
We may update these terms. If changes are material, we will let you know in the app or by email before they take effect. Continuing to use ThingSong after that means you accept the updated terms.
